Acceptance of These Terms

These Terms of Service govern your access to Prime Benchmark Private Limited's website, mobile applications, mock tests, learning content, support channels, and related services.

By accessing or using our services, you agree to these terms. If you do not agree, do not use the platform.

Eligibility and Accounts

• ▸You must provide accurate registration, contact, and payment confirmation information when requested.
• ▸You are responsible for all activity under your account and for maintaining the confidentiality of your login credentials.
• ▸One paid account is intended for one learner unless we expressly approve a group or institutional arrangement.
• ▸If you are using the service on behalf of a training center, sending organization, or employer, you confirm you have authority to bind that organization.
• ▸We may require identity or payment verification before granting or restoring access where fraud, abuse, or account-sharing is suspected.

Plans, Trials, and Payments

• ▸Free trials, demos, promotional access, and plan features may differ from paid plans and may be changed or withdrawn at any time.
• ▸Paid plans are one-time purchases for the stated access period; they do not auto-renew unless we clearly state otherwise at checkout.
• ▸Prices, plan duration, included mock tests, and support scope may change prospectively.
• ▸Payments may be collected or verified through third-party payment providers, bank transfer, wallet services, or manual receipt confirmation.
• ▸Access typically begins after successful payment or payment verification. Delays caused by incorrect payment details, incomplete receipts, or third-party provider issues are outside our reasonable control.
• ▸Unless we state otherwise in writing, taxes, bank charges, telecom charges, and currency conversion fees are your responsibility.

Permitted Educational Use

• ▸Our content is licensed, not sold, for your personal educational preparation use.
• ▸You may use the platform to practice, review explanations, track your performance, and prepare for relevant language or skill exams.
• ▸You may not use our materials as an official exam, employment screening tool, or certified training program unless we expressly authorize that use in writing.

Prohibited Conduct

• ▸Copying, scraping, recording, redistributing, selling, sublicensing, or publicly posting our questions, explanations, screenshots, videos, analytics, or answer keys.
• ▸Sharing account access, using multiple accounts to bypass plan limits, or impersonating another person or organization.
• ▸Using bots, scripts, automation, reverse engineering, or other technical means to access, extract, test, probe, or interfere with the service.
• ▸Uploading unlawful, abusive, defamatory, infringing, or misleading content in comments, messages, or support interactions.
• ▸Claiming or implying that Prime Benchmark is an official exam body, immigration authority, recruiter, visa sponsor, or government partner.

Community Features and User Submissions

• ▸If you post comments, reactions, feedback, reviews, or other submissions, you grant us a non-exclusive right to host, display, moderate, and use that content to operate and improve the service.
• ▸You remain responsible for what you submit and must ensure you have the rights needed to share it.
• ▸We may remove, hide, or moderate user submissions that violate these terms, create legal risk, or undermine the quality or safety of the platform.

Intellectual Property

• ▸Prime Benchmark and its licensors own the platform design, question banks, explanations, analytics output, written content, branding, code, and other original materials on the service.
• ▸Official exam names, trademarks, and logos remain the property of their respective owners and are used only for identification, comparison, or commentary purposes.
• ▸No ownership rights are transferred to you merely because you purchase a plan or access a free trial.

Independent Preparation Service

Prime Benchmark is an independent preparation provider. We are not affiliated with the Japan Foundation, Prometric, the Immigration Services Agency of Japan, or any Specified Skilled Worker test sponsor unless explicitly stated by an official written partnership announcement on our website.

Our mock tests, score estimates, analytics, recommendations, blog content, notices, and support guidance are designed to help with preparation only. Official exam rules, schedules, registration procedures, fees, scoring, results, and visa decisions are determined solely by the relevant official bodies.

No Guarantee of Results

• ▸We do not guarantee that you will pass any exam, obtain any score, secure employment, receive a visa, or achieve any specific outcome.
• ▸Testimonials, score improvements, pass-rate references, salary examples, or learning timelines shown on the site are illustrative and not promises of typical results.
• ▸Your success depends on many factors outside our control, including your study effort, exam-day performance, official rule changes, language level, work history, and immigration requirements.

Service Availability and Changes

• ▸We may update, suspend, restrict, or discontinue features, content libraries, exams, support channels, or pricing at any time.
• ▸We do not guarantee uninterrupted or error-free access. Scheduled maintenance, telecom failures, device issues, browser incompatibility, force majeure events, or third-party outages may affect availability.
• ▸We may change or remove content where exam formats, official guidance, or legal requirements change.

Refunds, Credits, and Chargebacks

• ▸Because digital access can be consumed immediately, purchases are generally final once access is granted.
• ▸If a genuine technical issue on our side materially prevents access, contact us within 24 hours of the issue with enough detail for us to investigate.
• ▸Where we verify a platform-side problem, we may choose a reasonable remedy such as account restoration, extension, service credit, replacement access, or refund.
• ▸Chargebacks or payment reversals made without first giving us a reasonable opportunity to investigate may result in suspension of associated accounts.

Third-Party Services and Links

• ▸Our site may link to payment providers, app stores, messaging platforms, social media services, official exam websites, or other third-party resources.
• ▸We are not responsible for the availability, content, privacy practices, or terms of third-party services.
• ▸Your dealings with third parties are between you and that third party.

Suspension and Termination

• ▸Termination does not waive payment obligations already incurred or any rights and remedies that accrued before termination.

Disclaimers of Warranty

To the fullest extent permitted by applicable law, the service is provided on an "as is" and "as available" basis. We do not warrant that the service will be uninterrupted, accurate, complete, secure, current for every official change, or suitable for your specific goals.

Nothing on the platform constitutes legal, immigration, employment, medical, or professional regulatory advice.

Limitation of Liability

To the fullest extent permitted by law, Prime Benchmark Private Limited and its officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, opportunities, data, goodwill, exam opportunities, visas, or employment prospects arising from or related to your use of the service.

Where liability cannot be excluded, our aggregate liability for claims relating to the service will not exceed the amount you paid us for the relevant plan during the 3 months preceding the event giving rise to the claim.

Indemnity

You agree to indemnify and hold harmless Prime Benchmark Private Limited from claims, liabilities, damages, losses, and expenses arising out of your misuse of the service, your submissions, your violation of these terms, or your infringement of another person's rights.

Governing Law and Disputes

These terms are governed by the laws of Nepal, without regard to conflict-of-law rules.

You agree to try to resolve disputes with us in good faith first by contacting us. If a dispute cannot be resolved informally, the courts of Nepal will have exclusive jurisdiction unless applicable consumer law requires otherwise.

Changes to These Terms

We may update these terms from time to time. The updated version will apply from the "Last updated" date shown on this page.

Your continued use of the service after updated terms become effective means you accept the revised terms.
